Terms & Conditions

1. Introduction

1.1.

These Terms & Conditions (hereinafter referred to as "Terms") govern the provision of coaching and teaching services by Daniel Maliy, Waarheid in Actie, ( or “Truth in Action” as translated for the English audience - hereinafter

referred to as the "Teacher") to the client (hereinafter referred to as the "Client").

1.2. By using the services provided by the Teacher, the Client agrees to be bound by these Terms.

2. Services

2.1. The Teacher agrees to provide teaching and/or coaching services to the Client as described in the coaching agreement signed by both parties.

2.2. The Teacher will use their best efforts to assist the Client in achieving their goals, but the Client acknowledges that results are not guaranteed.

3. Payment

3.1. The Client agrees to pay the fees as outlined in the coaching agreement.

3.2. Payment shall be made in accordance with the payment terms specified in the coaching agreement.

3.3. All fees are fully related to the services provided by the Teacher only.

3.4. All fees paid for teaching and/or coaching services are non-refundable. Once payment is made, it is considered a commitment, and refunds will not be provided.

3.4. Additional costs will be charged separately to the Client.

3.5. Bank fees, in case of international payments, can also be required to be paid by the Client.

4. Cancellation and Rescheduling

4.1. The Client may cancel or reschedule coaching sessions by providing 2 working days' notice to the Teacher.

4.2. The Teacher reserves the right to charge a fee for missed or late-cancelled sessions.

4.3. The Teacher reserves the right to cancel sessions if the payment terms, as specified in the coaching agreement, are not met.

5. Liability

5.1. The Teacher is not, nor claims to be a (fully) licensed mental health professional, and their services are not, nor can be seen as a substitute for medical or psychological treatment.

5.2. The Teacher is not liable for the Client's mental condition or any consequences arising from the teaching or coaching sessions.

5.3. Any liability is limited to two times the paid and received fee over the previous quarter.

6. Confidentiality

6.1. The Teacher agrees to keep all information provided by the Client confidential, except as required by law.

7. Governing Law

7.1. These Terms shall be governed by and construed in accordance with Dutch law.

8. Amendments

8.1. The Teacher reserves the right to amend these Terms at any time. The Client will be notified of any changes.

9. Entire Agreement

9.1. These Terms constitute the entire agreement between the Teacher and the Client and supersede all prior agreements, understandings, and representations.
